Our local justice system, a cornerstone of community safety and fairness, relies heavily on the dedication of legal professionals. However, a recent discussion at Parliament Buildings has highlighted serious concerns about the safety of these vital workers, revealing a worrying trend of threats and abuse faced by those upholding the rule of law.
A recent survey conducted by the Law Society of Northern Ireland painted a stark picture, with a significant 66% of legal practitioners reporting that they have been subjected to some form of threat or abuse in their line of work. These incidents range from relentless online harassment to unsettling physical attacks, creating an environment where performing their duties can be dangerous.
In response to this growing concern, there's an urgent call for the upcoming Sentencing Bill, which is soon to be introduced in the Assembly, to provide explicit protection. This crucial bill is set to include a new offence and impose higher sentences for assaulting individuals providing a public service or performing a public duty. Advocates are strongly urging that legal practitioners be specifically named within these provisions to ensure their robust safeguarding.
David A. Lavery CB, Chief Executive of the Law Society Northern Ireland, stressed the critical nature of the issue. "Threats and attacks on solicitors, barristers, and justice sector staff strike at the very foundation of the justice system," he stated. "Legal practitioners are officers of the court – when they are threatened or attacked, the rule of law itself is under assault. This Sentencing Bill offers a once-in-a-generation opportunity to ensure their protection."
Denise Kiley KC, Vice Chair of the Bar Council Northern Ireland, echoed these sentiments, highlighting the importance of the recent discussions. "Ensuring that legal practitioners can carry out their work safely is fundamental to the effective functioning of our justice system and the maintenance of the rule of law," she affirmed.
Stewart Dickson MLA, Chair of the All-Party Group on Access to Justice, expressed his gratitude to those who shared their experiences. "It was a privilege to hear directly from practitioners and those who work at the coalface of our justice system every day," he commented. The hope is that by acknowledging these challenges and taking decisive legislative action, our community can support a justice system where everyone, including those who serve it, can operate without fear.
